Insurance cover for contractors needing cover for non-negligent damage to adjacent or neighbouring properties resulting from works being carried out, including basement excavations.
In some cases, public liability insurance will not cover you sufficiently when working on certain types of contract. Damage to a 3rd party property will only be covered if you are proven to be negligent and therefore liable. This could leave some contractors in a very difficult situation if the damage caused isn't due to negligence.
JCT 21.2.1 insurance or non-negligence insurance, is an insurance policy placed in the joint names of the contractor and employer and is placed in respect of legal liability for damage to adjacent or neighbouring properties whilst work is being undertaken to your property.
What is covered by JCT 21.2.1 Insurance?
JCT 21.2.1 is usually obtained by the contractor on behalf of their employer to provide cover against the liability for loss, claims or proceedings due to non-negligent damage to a property while undertaking a building contract due to any or all of the following:
- Weakening or removal of support
- Lowering of groundwater
